When a patient visits a hospital, doctor’s office, dentist’s office, or any other type of medical facility, he or she may receive a prescription for a medication. Prior to receiving that prescription, however, the patient is supposed to be asked if he or she has any known allergies to medication. If the patient says no, but still has an allergic reaction after taking that medication, this is not a case of medical malpractice because the patient was either not aware of the allergy or did not properly inform anyone of it. However, if the patient makes the medical professional aware of his or her medication allergies and they are still prescribed something that they are allergic to, a medical malpractice lawsuit may result.
