Illescas Brothers Construction Inc. Cited For Twelve Different Safety Violations

A construction business, Illescas Brothers Construction Inc., has been fined by the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) for more than $65,000 for exposing workers to various dangers such as improper scaffolding. The citations occurred on Monday when the Paterson-based company exposed their workers during a Fort Lee new home construction to twelve safety violations while performing masonry work and were violating many scaffolding and fall protection safety precautions. OSHA also stated that similar safety violations were already filed a few years ago for violations during an Edgewater construction job. The construction company could not be reached for comment regarding the violations and citations.

Illescas Brothers Construction Inc. faces $55,440 in fines for three replicate violations, including neglecting to use appropriate scaffolding and supply fall protection for workers involved in scaffolding. These were the same issues and safety violations that the company received citations for back at the Edgewater site in 2007, according to a news release.
OSHA also stated that there was six severe breaches of safety with $9,900 in fines, such as neglecting to execute a respiratory protection plan, safeguard workers from falling material and supply safe access to a landing surface. A severe safety breach happens when there is a great chance that severe, catastrophic physical harm or death could be the direct result from a danger about which the company knew or should have been aware of, according to OSHA.
Although they did not receive additional fines, there were other safety violations that OSHA noted in their report. These other violations include failing to supply a written dangers communications program, the lack of a portable fire extinguisher, and neglecting to make a material safety data sheet easily accessible, OSHA said.
The construction company has fifteen business days from the date of receiving the citations to act in accordance with the imposed fees, request for an informal conference with OSHA's area director or challenge the citations and proposed fees before the independent Occupational Safety and Health Review Commission, a news released also added.
