Probate court jurisdiction often overlaps with other courts, especially in cases of contested wills and inheritance lawsuits. Probate courts have wide jurisdiction over all matters relating to succession, inheritances, civil commitments, guardianships and conservatorships. For example, family and probate courts may both be handling a case involving minors. The probate and bankruptcy courts work together to resolve cases where a bankrupt entity’s estate has been taken over by a probate court appointed administrator. However, most probate courts will limit their involvement in a case to matters which are brought to their attention.
