Local Law Firms Home > Personal Injury News > Nine-Year-Old Boy Hit and Killed By Daycare Bus Buffalo Police have resumed investigating the crash that fatally injured 9-year-old Darpan Niroula. The crash occurred around 5pm at Prospect and Rhode Island roads on the West end of Buffalo. The child was crossing the road with his 15-year-old brother Chandra close to their home when he was struck by a small church daycare bus that was dropping children off from a local daycare. Officials say there were seven children on the bus, four of whom belonged to the female bus operator. Law enforcement officials say Darpan was struck by the front of the bus and was pronounced dead at the scene. Chandra was not injured but ran to his home, just feet from the scene, to inform his family. Frank Bogulski, lawyer for the family, says the purpose of the case is to compensate the family for the teen's shock and emotional turmoil that resulted from the crash. Bogulski said a wrongful death case will be filed later this week in Surrogate's Court. The bus was from a close by church day care program but at this time, law enforcement officials aren't releasing the name of the church. The 9-year-old victim and his family relocated to Buffalo from Bhutan in Southeast Asia in June 2010. Darpan a student at School 18 in Buffalo and was in the fourth grade. Grief counselors were accessible for students the day after the terrible incident. A Catholic Charities case worker, Kaji Sunwar, said Darpan "loved playing with his friends and watching TV and playing with computers.” Law enforcement officials in Buffalo continue the investigation and say the bus operator has settled on complying with breathalyzer tests, even though they do not feel drugs and/or alcohol were a contributing factor in this tragic accident.
