West Virginia Legal Overview: Hagerstown-Martinsburg The Hagerstown-Martinsburg metropolitan area is officially known as the Hagerstown-Martinsburg, MD-WV MSA. It covers Washington County, Maryland, along with Berkeley and Morgan Counties in West Virginia. Both Berkeley and Morgan Counties come under the 23rd Judicial Circuit. The circuit courts located in Martinsburg and Berkeley Springs are the main trial courts with general jurisdiction over cases filed in Berkeley and Morgan Counties respectively. These circuit courts handle all the felony cases, and have jurisdiction over civil cases more than $300.

1. Morgan County comes under the 23rd Family Court Circuit, with the family court located in Berkeley Springs. This court handles all the divorce cases for the county, along with visitation issues, support, domestic violence-related civil matters, paternity tests, and other family law issues. Berkeley County comes under the 24th Family Court Circuit, with family court being located in Martinsburg. Each county also has limited jurisdiction magistrates to handle misdemeanors, ordinance violations, and civil cases not exceeding $5,000. Morgan County has two magistrates, while Berkeley County has five.
